In Oregon . . . it doesn't need to be at night or with the intent to commit a felony . . . and no one needs to be in the house . . . in fact it doesn't even need to be a house. Unfortunately . . . I know.

I was just trying to clear up confusion because in Oregon, those requirements (at night, in a house, to commit a felony) aren't needed to commit a burglary. It doesn't take much to commit a burglary out here . . . So if this kid was in Oregon and he went into an abandoned house to drink a beer or smoke a joint . . . that could be burglary in Oregon -------------------------------------------------------------------------------- ORS 164.215 Burglary in the second degree. (1) Except as otherwise provided in ORS 164.255, a person commits the crime of burglary in the second degree if the person enters or remains unlawfully in a building with intent to commit a crime therein. (2) Burglary in the second degree is a Class C felony -------------------------------------------------------------------------------- So boys and girls, words of advise. Don't go into your ex-girlfriend's apt and take her cell phone (even if you paid for it) . . .
A buddy of mine was charged for burglary after entering an empty apartment without permission in his building..... and when I say empty, I mean empty.... it was a vacant apartment.... unfortunately the cops were already banging down his door because of a trail of broken plastic lawn chairs leading back to his place, but that's a whole other story.
Actually, I would guess all those sexually violated pink flamingos interested tham more than the lawn chairs!
